Vlog 307: European Union might ban the use of memes because of copyrights. Could frictionless royalty payments be possible on a blockchain? + Steempay 0.3

BY: @exyle | CREATED: May 21, 2018, 9:41 a.m. | VOTES: 479 | PAYOUT: $316.49 | [ VOTE ]

I woke up this morning to a Dutch news article from the NOS. here.

It stated in the title that the European Union might ban the use of memes and it got my interest.

Because of possible new regulation websites that facilitate content with copyright should filter it out unless royalties are paid.

Basically if you use a photo, song or movie that has copyright it should not be showed unless royalties are paid by the website hosting it to the creator of the original content.

The decision wether this will happen will be in about 2 months.

It's surprising to me that we still have this discussion in 2018...but anyway..

I'm hoping that in the future when more and more people are on a blockchain that royalties will be an automatic process. Just like getting rewarded on the steem blockchain is a automated process.

There are no accountants anywhere typing up numbers and calculating who gets what on the blockchain it just happens automatically according to a set of rules.

It's a frictionless process.

Why can't this be the case for royalties? There is already software out there that can detect copyright materials in content.

If someone earns cryptocurrency from their own content (but used a copyright piece of content while creating it) why can't royalties be frictionlessly paid to the owner of the original content (maybe trough a smart contract?) from the earnings.

This way content could generate a continuous income stream for the original creator. They would probably welcome the use of their content and content creators could just freely create content without having to worry about these damn royalties.

If content creators get paid, copyright material gets paid too. Everyone wins.

Now, Is this a good solution? I'm not 100% sure. There is probably many aspects that I'm missing but at least it's thinking in solutions and not banning things.

I truly think the solution for these problems lies in Blockchain technology and cryptocurrencies and I talk about it in my vlog.

Steempay

Steempay is a cool little website were it is possible to generate a QR code to get paid in SBD but you fill in your local currency.

It's created by witness @asbear and version 0.3 was just released here.

Website: https://steempay.co/ (works best on mobile).

I filled in 10 euro and this was created (without the red lines):

[IMAGE: https://steemitimages.com/DQmWGfLJcwBqNkMVp2P1frWeWwtr2hevvQh6SDP6iwWXHe2/IMG_5487.PNG]

After scanning the QR code I was presented with this. Very handy! I could pay straight away with Steemconnect:

Dlive fantastic introduction post.

From the very beginning I realised that the blogging difficulty will go up in the future when more and better content creators will come to the blockchain.

I saw this introduction post by Bonnie Piesse and was very impressed by the quality. here

If this is a glimpse of the future. Well, we have our work cut out for us especially when SMT's come out.

Definitely, Blockchain is a great solution since it pays both the owner website and the one using it.

It could, but 'frictionless royalties' are not desirable in the first place. It would be better to drop the idea of information as property, it is untenable.

Very good post @exyle, this information is very useful for all of us, I think, it is a very good decision made by the European Union, because then, there is no longer a problem with copyright, and will give birth to all the content that original, and Steemit will be much more successful for the future. Thanks for sharing, and wish you a wonderful day... :)

I guess the real problem in the copyright industry is always the middle man, therefore a ban is a way better solution for now.
With time blockchain technology will hopefully disrupt all of this, whether they like it or not.

One just has to look at Steemit to realize it will be a long, long, long time before blockchain technology and it's lack of security will allowed to run the financial transactions of the world.

When I use someone else's material I link to the original publication so they get the views and likes, etc. It's actually quicker and easier to do it that way. Anything else I post is 100% my stuff, and yet I find it used all over fakebook and yootoob without consequence, while my originals don't get squat. The cost, time and effort it would take to discover and go after these thieves means that up to this point, they had free reign. Why steal from someone who provides free of charge to begin with? At least give that person the views and likes they deserve.

I think the frictionless solution would be great, but would require all platforms to participate in scanning and reporting. There are programs to wipe exif data from images making it hard to identify and this would require some image recognition software that can differentiate separate images taken of the same object without the exif data. Possible but at what cost?

Either way, glad to see that a number of us are actually looking at the problem with an eye towards a practical solution rather than a complete ban that at best would be difficult to enforce.

@exyle I guess it is possible to do this on a crypto platform. However, how will they ever ensure that royalties are being paid on platforms like Facebook, or Twitter. I see copyrighted content there all day long. I guess they will never be able to put a hold to that.

@ijatz | May 21, 2018, 4:56 p.m. | Votes: 0 | [ VOTE ]

Hello @markdeheide, nice to Steem you! :-)

Maybe a precedent in that way is the European Union directive on the so-called "fake news", through which it seems the E.U. succeeded in obtaining from Facebook and Twitter an adaptation of their algorithms that allows posts filtering (and free thinking inhibition, but that's another theme ;-) ). They probably could automatize in a similar manner copyrighted content detection and royalties payment...

@markdeheide | May 21, 2018, 5:06 p.m. | Votes: 1 | [ VOTE ]

@ijatz ow yeah true. Keep in mind though people aren't paid for placing content on Facebook or twitter, so there are also no payments to be forwarded. On YouTube this is already happening on a massive scale.

I agree! I also agree with you that blockchain technology is the answer to solve this issue. As a matter of fact I believe blockchain technology is the answer to anything when it comes to any sort of payments. It’s not “IF”, it’s “WHEN” this happens. I’m also really happy to see steempay, it’s only confirming what I believe will eventually happen. I wouldn’t be surprised 😮 if in few years Steem would be known all over the world just as well as bitcoin. Can’t wait for SMT’s to finally come out. It’s really exciting, the expectation, everything...

Great talk this morning especially on smart contracts. I too would like to see an increase in their use for royalties, taxation, levies, tariffs etc. It just makes life easy for everyone. The best part is that we have Ethereum, NEO and the upcoming EOS among others; where these smart contracts can be built. So hopefully in the future things will be better. In the US, the tax code is quite complex. We have federal. State, and local taxes. There are income, sales, and property taxes. Blockchain integration is seemingly impossible. It is frightening to consider such potential.

I personally think copywrights are ridiculous. how can you expecct money because someone else was able to recreate your work.

If youwere unable to monetize and they were it sounds like thats a problem of resources or ability... maybe i dont understand patents enough but if you don't want something copied don't make it...

you cant expect to monopolize an industry just because you created it. that's like the first cellphone company patenting cellphones and saying no one else can make/sell these without paying me. Rudiculous

Very cool. Doing photography and videography, things get stolen even from the main stream media MSM! I have had content downloaded off YouTube by abc news, then they edited out our logo, and colored their footage to look like theirs so it would match. Had no clue if I should be happy my stuff was used on TV, or mad I didn’t get any credit, or compensation.

Having redundant new talking points is what spins sensational content and makes it go viral too. If we have a check for that at least the minnows would get their dues.

Anyone know of the Need for a job bank or content basket that lets folks use material copywrite free. Just have to search a bit!

That's stupid, memes are fair use because they are satire, if you just used the image unedited perhaps they would have a claim but the whole point of a meme is to mock something by altering something else, memes are satire. A meme is no different from a Weird Al Yankovic song.

On the other hand I would like to see the EU try it. That would be interesting.

Steempay Steem Is The Free Paypal Of The Cryptocurrency Steemit World

Why? Because users can buy more for less as Steem curreny is virtually free money that anyone can earn on Steemit.com.
Moreover, sellers can sell more to buyers that have easy Steem money.
Unlike Paypal customers who pay with hard-earned fiat currency, Steempay customers can very easily earn more Steem currency by simply creating more quality blogs on Steemit.

Steempay is a win-win proposition for Steem buyers and sellers alike.
SteemPay is the world's easiest digital currency wallet.

Hello @funbobby51, and nice to Steem you! :-)

Well, as far as I know nor in the United States of America nor in the European Union the copyright laws allow royalty-free use of a material on the basis of the satirical, parodic or humorous intention of the "second hand" author, and I guess it partially derives from the interpretation margin which would arise from such a subjective claim (a same artwork may be seen as a parody from its content creator point of view, and as a plain political or social statement from other viewers opinions).

In case it doesn't exist yet, and following your suggestion, it'd be beneficial to promote the adoption of a "humorous" Creative Commons licence attribution :-)

@funbobby51 | May 21, 2018, 4:55 p.m. | Votes: 0 | [ VOTE ]

Upon further reading I will change my argument to say that memes are parody.

Parody is very strongly protected while satire is less so but still protected.

https://apps.americanbar.org/litigation/committees/intellectual/roundtables/0506_outline.pdf

they note that:
>satire that does not target the original work can be considered fair use if, for instance, there is little possibility that consumers would view the satire as a commercial substitute (§ 107(4)), or if only a small amount of the copyrighted work was used (§ 107(3)).
C

I think a single frame from a movie that has been turned into a meme satisfies both of those conditions.

>On the other hand I would like to see the EU try it. That would be interesting.

Only thing that would get harder would be banning cryptos. I'm a big advocate of copyrights and patents. But just like any other great tool like nuclear energy etc. it can be used for very destructive means and that's what these idiots have been doing for some time (with patent trolls and other scum)

They need to understand why copyrights even exist in the first place. Copyrights let the creators make money off of their creations. It's pretty much like having a bounty on something. there is a lot of incentive to create and creators can be self sufficient without sponsors.

EU needs to get schooled on fair use.

The meme police will be kicking down doors across the continent while the bus stations become rape rooms.

"They need to understand why copyrights even exist in the first place. Copyrights let the creators make money off of their creations. "

Exactly, no one is going to confuse a meme with the movie it came from nor will it prevent the author from making money off of it. No one is going to stop making movies lest a frame becomes integrated into a meme.

If content creators get paid, copyright material gets paid too. Everyone wins.

This I think would be the best solution.... Unless some authors don't want to sell their content.

I think it's great to create @asbear.... How fast we are moving forward and evolving the blockchain and its applications.

That is moronic, images are reasonable utilize in light of the fact that they are parody, on the off chance that you simply utilized the picture unedited maybe they would have a claim yet the general purpose of an image is to taunt something by changing something different, images are parody. An image is the same as a Weird Al Yankovic melody.

Then again I might want to see the EU attempt it. That would intrigue.

Of course I share the same opinion as you do, crypto is the answer to many problems but it still to small and unknown for now. And we have to think how old the EU foundation is and their bases, they always opt for the easy way, to avoid bigger problems, the reality is that, if nothing is ventured, nothing will be gained.

Always useful videos, let's see the destiny of "memes", I don´t know how they will control it if they ban it... Or they are expecting for the Europeans to just obey and that's it?

@jennifer78 | May 21, 2018, 7:58 p.m. | Votes: 1 | [ VOTE ]

I am surprised to hear that they are considering a ban on memes! They are meant to be funny and satirical. Paying to use a meme that you create seems like craziness. Pretty soon I will just be taking photos of myself and making my own memes. Could I get royalites for that? :)

Will the EU also ban political cartoons in newspapers?
I 'd expected far more meme's as a reply on a meme topic so for a part EU has an advantage already

I love your passion for #solutions and as you explain it 'frictionless' solutions could be a clear wave to our future! Yup! I think that's another big reason I keep returning yo your blogs. I am also not 100% sure but, maybe the app that names songs is called 'songza' i have heard of it but never used it.

Thank you Exyle for very informative information.
On another topic regarding the European Union.
Feta, parmesan and prosecco names could be banned in Australia. It’s clear to me that some producers in Australia could be hurt by the EU resulting in loss of business and jobs.
We could look at this as an opportunity.
Australian producers could start naming their own products making Australians products more competitive.

Copyright LOL.

according to what law? Dutch, German, Icelandic, Chinese (do they even have copyright laws?)

If i write something under Dutch law, publish it on a 'cloud' server hosted in ... Germany and, decentralised steemit centralizes its part un the US because \uber steemian ned happens to be in bed with the US law benders and someone in Austria with a Swedish VPN reads my post then how do i get my money from Sweden? ?????
Since the VPN is in Sweeden the IP of the guy from Austria now looks swedish I would want to claim by antiquated copyrights in sweden.
But as ned is an American entrepreneur he will assume that everything needs to be under US law since the rest of the world is subjective to the US dollar. But wait, i published on a German server so Germany should receive money from Austria (through Sweden) and pay me what Dutch law says i would be entitled to. Since i produced it under Dutch law.

I wish ned a happy nightmare on steroids. to implement this on his un-de-decentralized-hierarchie LOL

The problem with the European Union is that it is too bureaucratic, even if something works well, there will always be someone who wants to change it. Politicians must change the law all the time, without it they would be unemployed. Unfortunately, we suffer from this, they consider themselves as the saviors of the world. Blockchain is an evolution that will change the world, it has already begun. I wonder what the future will bring

The EU was unelected and is part of the NWO and is bringing forth agenda 2030 and much more. They're killing us like Kanye West said, we are drugged out, and I'm linking my new article to this post. Thanks.
