yes that sounds like theft. its like using someone's internet that is not being used by them. even if you can prove that they are not harnessing the power being wasted it would still require an approval from someone i guess.
If you are able to use a device that could convert electromagnetic flux into electricity, can you be charged with theft for doing so?
